ParticipantThe first part is Beach Drive through Rock Creek Park. I live in Grosvenor Park which is about 10.2 feet from Rock Creek Park. This route takes Rock Creek Park to the intersection of the Capital Crescent Trail (Georgetown Branch) and I take that through Bethesda and all the way down to Georgetown. The kayak rack in the last frame is where I have my kayak at Jack’s Boat House. Usually if I do this, I will make a 30 mile loop and ride all the way back up through Rock Creek Park. The Rock Creek trail and CCT both terminate at the Georgetown Waterfront so it makes for a perfect circle.

ParticipantOn the CCT, there was a gentleman that commuted with his electric bike zipping up and down. This perturbed a number of people including the national park police. Now with that said, had he not pissed off the other trail users, I doubt anyone would have called the NPP nor would the NPP have actively sought him out.

ParticipantThe situation is not even remotely the same. But none the less, being found negligent at several lower levels is meaningless with the faulty jury instructions. So point is moot.
Based on the limited description provided in this briefing, his argument for appeal is absolutely correct. You can’t just modify the law to be more fitting for your court case. As for who was right and who was wrong, it could go either way. I think they were both wrong. The driver was wrong for not yielding to the cyclist. The cyclist was wrong for assuming a car stopped at a stop sign was indeed waiting for him to pass by and blowing through the intersection on that assumption. They should both be assigned blame and be kicked out of the court for wasting our time and money. This is nothing at all like the OP’s accident.

ParticipantI don’t know what their ultimate plans are. However I wouldn’t be holding my breath on them widening it. The barrier is nice, I feel much less like I’m about to die. But it is a problematic section since it just barely wide enough for two-way ped/bike traffic.

ParticipantIt’s actually just a still frame-grab from the video. I have my GoPro video camera mounted to the handle bar (or on a chest mount, or helmet mount, or on the front fork). I got home and was like “I have got to find that wierdo and post the picture!!!!”

The people that are are dumb on their bikes or hog entire roads for themselves on a bike are probably just are dumb and just as big a road hog in their automobile too. Nothing pisses me off more than when someone decides to take and entire road for themselves when there is a 6ft wide bike lane shoulder. Get over yourself, nobody thinks you are hot shit because you have a fake jersey and are hunched over on your expensive bike. Hogging the road and being an inconsiderate jackwagon on a bike is just as bad as being a road hogging inconsiderate jackwagon in a car.
Behavior like the OP describes is ASKING for an accident. “We have equal right to the road” my ass. We weigh 150lbs and are balanced on two wheels with no protection. They weigh 5,000lbs with four wheels and a stereo. There is nothing equal about that and anyone feels they can “make themselves equal” needs a wake-up call.

ParticipantThe law says AT the crosswalk, not IN the crosswalk. And the enforcement by police on the matter backs up my points. If someone is standing at the curb waiting to cross, vehicle traffic must yield. End of story. You can go on and on all your want. Your interpretation is still incorrect and not in line with precedent either. And your entire interpretation of what happened in this incident remains to be incorrect.

ParticipantThe C&O canal tow path is not transportation infrastructure. It is a recreational park and part of the NPS. I don’t know why it would ever be getting transportation funds. If it is damaged, the NPS should be figuring out how to fix it with their funding.

ParticipantThe MUTCD is irrelevant. It is not motor vehicle or pedetrian law. It is guidebook for road design and markings. It is no more applicable than book you buy in the bike shop on biker’s responsibility.
A person at the curb waiting to cross is at the crosswalk and requires traffic to yield. The law is written very clearly in that manner and there is enforcement action by the police to back it up. You’re still making up law and procedure that doesn’t exist.
