I think engine size has something to do with it–I remember being told that 50cc mopeds don’t have to even be registered? Can anyone confirm?

If it was a true Italian Vespa, it’s allowed. If not, then not. If Audrey Hepburn were riding it, you would be required to yield.

For all practical purposes, anything 50cc and over is considered a motorcycle in both DC and VA.

My understanding is that mopeds/scooters of any displacement are explicitly forbidden from using bike lanes in DC. VA, however, seems to allow use of bike lanes for scooters/mopeds under 50cc.

In DC, any scooter/moped under 50cc has to be registered and insured, but the rider doesn’t have to have a motorcycle endorsement. In VA, scooters/mopeds under 50cc have to be registered, but not insured, and no license of any kind is required.

Here’s a chart (revised in May 2013) that the DC DMV offers on motorized bicycles: http://dmv.dc.gov/sites/default/files/dc/sites/dmv/publication/attachments/May%2017%202013%20Non-traditional%20Motor%20Vehicle%20chart.pdf

According to the chart, a Vespa would not be allowed to use any bike lane.

There is an older chart online from 2008 that says that they would be allowed in bike lanes, but that was changed in 2013.

Thanks for the update! I hadn’t heard about the change.
