So I come back to work to find that my agency has (finally) instituted the bicycle commuter benefit. HOORAY.

But, oddly, they have modified the IRS language (which just says “bicycle”) to use “non-motorized bicycle” – so we have to attest that we’ll use a “non-motorized bicycle” for the majority of our commutes or something like that. Has anyone else seen this? Does anyone know of an employer (federal or not) that expressly allows ebikes in its policy?

(I won’t get into it here, but I think there are valid arguments that an ebike that meets the statute’s definition qualifies as a “non-motorized bicycle” anyway, but I’m irked that they bothered to change the language from the IRS statute and guidance.)

Those darn bureaucrats and their intrusive word-smithing!
